Protection Against Recovery Agent Harassment
Defaulting on a debt is a civil contractual dispute, not a criminal offense. The Reserve Bank of India (RBI) strictly prohibits banks, NBFCs, and third-party recovery agencies from resorting to intimidation, verbal abuse, public humiliation, or visiting borrowers at inappropriate hours.
Key RBI Directives on Recovery Conduct:
- Time Restrictions: Recovery agents may only contact borrowers between 8:00 AM and 7:00 PM. Calling before 8 AM or after 7 PM is a direct regulatory violation.
- No Contact with Third Parties: Agents cannot call your relatives, employers, or friends to disclose your debt details or demand repayment from them.
- No Obscene or Abusive Language: Threatening physical violence, using foul language, or sending fabricated court summons on WhatsApp is punishable under law.
- Mandatory Identification: Recovery personnel must carry an authorized bank authorization letter and valid identity card when visiting a borrower.
How We Defend Borrowers Legally

We issue a legal notice to the bank's Nodal Officer and Legal Cell notifying them that you are represented by counsel and directing all correspondence to lawful channels.
RBI CMS & Banking Ombudsman Escalation
If harassment continues, we draft and lodge formal complaints on the RBI Complaint Management System (CMS) portal and before the Banking Ombudsman.
Evidence Documentation Strategy
We guide you on safely recording audio calls, preserving abusive WhatsApp messages, and collecting CCTV footage required for police complaints under the Indian Penal Code (IPC).
