1. Nature of Services
DebtsFree provides independent financial, documentary, and negotiation consultancy services to assist borrowers facing difficulty in servicing credit facilities. DebtsFree is NOT a banking institution, non-banking financial company (NBFC), government agency, credit information bureau, or debt collection agency.
2. No Guarantee of Settlement or Specific Reduction
DebtsFree is a debt resolution consultancy. Settlement is subject to lender approval and is not guaranteed. Reduced settlement may affect your credit report and future borrowing. This is not legal advice. Please consult an independent legal professional for advice specific to your situation. The decision to accept, modify, or reject a compromise settlement proposal rests entirely within the commercial discretion of the respective bank, NBFC, or financial institution. DebtsFree cannot guarantee that any specific settlement percentage or waiver will be granted.
3. Client Responsibilities & Truthfulness
The client agrees to provide accurate, truthful, and complete financial statements, sanction letters, and notice records. The client agrees not to submit forged, altered, or fraudulent hardship documentation.
4. Remittance of Settlement Funds
All settlement payments agreed upon via an official OTS must be remitted by the borrower directly to the lending institution's designated account. DebtsFree staff are strictly prohibited from receiving or escrowing loan principal settlement funds.
5. Governing Law & Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of India. Any legal dispute arising under these terms shall be subject to the exclusive jurisdiction of the competent courts in Gurugram, Haryana.
